This text is very controversial. Mikdashi states that "when two people get married, they are granted rights to each other's bodies and their resources (and yes, the fact that these two come together is interesting to say the least)" and that " civil law (largely inherited from its
French counterpart) expressly exempts husbands from punishment and states that
if someone other than the husband commits rape then
it is a criminal act". Is marital rape a crime and should it be penalized?
I am just going to start the conversation. I believe rape is rape is a criminal act. It should be treated like any rape unless the wife does not seek legal action. Just my five cents.
ReplyDeleteI agree with what the author said in the beginning which is that rape is rape and that it isn't really hard to take a stand against it and that it isn't controversial. It is true that in marriage two people are granted rights to one another's bodies, but that doesn't mean that the husband or the wife have the right to abuse these rights. So, marital rape should be considered a crime and must be penalized.

It is crucial that one knows what one is entitled to and when one's rights are violated and how to rebel against discriminatory laws. It does not matter in what context the act of rape takes place, it should be penalized. The fact that we live in a patriarchal society, that stems from the roots of religion and a biased judicial system, has shaped the way we react to certain sexual injustices as if we adapted to them and consider inequality as something natural.It is quite ironic that religion would be in consent with the violation of something sacred (the body).

Men often believe that when they marry a woman, they believe that they are entitled to possess her body and thus marital rape occurs. Law should be passed in order to protect the rights of one.
DeleteRape should be penalized in all its kinds. Marriage is a commitment each of the couple make where they promise to love, respect, honor, and support each other. None of them has the right to break these promises, and rape is an extremely harsh betrayal that the person should be penalized for. Marriage is a commitment that forces each of the couple to love and respect each other; however, marriage does not by any mean give the permission to hurt or rape the partner. I also believe that marital rape should have a higher penalization than any other kind because the offender is supposed to be a lifetime partner.

It is one that bears a lasting impact on the woman, both physically and psychologically; yet it is still an issue that has not been given the adequate attention it deserves as compared to rape by a stranger. Socially, marital rape is a term that few are able to accept and understand. Many still hold the view that once the bond of marriage has been entered, it is the woman's duty to satisfy her husband, which is totaly wrong.

No matter the relationship status of the couple, martial rape should not be accepted even if the wife did not file for legal action. Female spouses are old enough and wise enough to know whether they want sex or not and do not need their aroused husbands to force it.

Surprisingly, civil law in Lebanon exempts martial rape as a crime, which shows how far we are back in time and how all of our advancements in humanity in time have meant merely nothing. All feelings aside, there must be drastic changes to counteract this cancerous ideology that should not be taking place today.
No matter who they are, No matter how they are related , No matter what laws exist, no human has the right to make a decision on behalf of another. The only thing in this world that we own and that we ever will have one hundred percent control over is our body. From our first breath we should be entitled to make our own decisions. Rape is wrong. Rape in a marriage is wrong because it is still rape. From the first sentence in the text the writer clearly states his opinion that no matter in what circumstance rape is wrong. Now the question is should it be penalized? Definitively yes, and not just by a simple punishment. Just because the accused violator is one's partner does not give him/HER the right to claim ownership of another human being and subject them to physical and sexual abuse. In my opinion the accused must face the same charges in this situation as one would if accused of rape against a stranger, moreover another person. The giving up of one's body during intercourse is something that is so intimate that it involves literally giving one'self up for another. This process is priceless. In these terms rape involves the 'taking by force' or robbing someone of that which it priceless and I say if i am placed to judge the accused must face a serious degree of disciplanary action such as imprisonment for a long, long time.

If a man is granted the woman's body, he considers it as his own. Would he subject his own body to rape? I don't think so. ReplyDeleteI strongly stand by the fact that marital rape must be and sanctioned. And the fact that a man is capable of such cruelty towards his wife is unthinkable. Marriage is in fact a form of security and such actions shouldn't take place.
At the end, rape is rape and rape is a crime. Marital rape should be sanctioned. For me, marital rape is even more inconceivable than 'normal rape'. How can someone who supposedly loves his wife and lives with her be capable of inflicting such animosity on his partner?

ReplyDeleteSecond of all, Lebanon’s constitution does not include until now laws that give penalties for marital rape. In a way, it is legalized. I agree with the author to demand for a law that defends women suffering from marital rape/abuse.
This is reminding of a story I heard it on the tv the other day :
in Saudi Arabia, a man was violently abusing his wife in public. All the people around them just stood there watching. But one man (maybe the dumbest of them all) came across the crowd and rescued the helpless woman by hitting her husband. The next morning, The man who rescued the wife was brought to jail by the authorities for "intervening in other people's business".
When two people get married, they promise to love and respect each other no matter what. Some men take advantage of their "husband" title and consider it okay to rape their wife just because she "belongs" to m. I think that marital rape, just like any other act of rape is a crime. It should never be okay to rape someone and I strongly believe that people who commit any type of rape should be punished.

ReplyDeleteRape whether marital or not is a crime. Marriage is a bond based on love and respect. It doesn't entitle you the rights to your partner's body. Coercing someone into a sexual act just to fulfill your bodily desires is an inhumane act of weakness. If you're regarded in a marriage as an equal and if you're truly loved then marital rape wouldn't occur. Surely women are responsible agents but in the case of rape there's no blaming them. Criminalizing marital rape is one step forward towards an equal society and a crushing blow to the ascension of patriarchy.

Just because they are married and have most likely willingly slept together many times before, it is very possible for a spouse to aggressively force the other partner into sexual intercourse against their will. This type of violence and psychological abuse is not what should be happening in a relationship between two loved ones. Married couples should respect and treat each other with affection and great care. Rape is a crime. There is absolutely no justification for it. The law must criminalize martial rape and penalize those who refuse to abide by the law.
ReplyDeleteI completely agree. Being married doesn't give a man the right to "play" with a woman's body as he pleases. Personally, when i'm being forced to do anything i don't feel like doing, it bothers me a lot. I can't even imagine how much being raped is psychologically disturbing for a woman, but also how much it would reduce her self insurance, and how belittled she must feel. This woman will suffer so much that it will influence her behaviour, her trust issue etc.

When someone, regardless of who that person is, violates someone else's personal space in such an atrocious manner, it should be considered a criminal act. A human being’s body doesn’t belong to anyone other than that human being. A husband does not own his wife; just because he is married to her doesn’t mean that he is entitled to do whatever he wants with her.

Women need to start speaking up and refuse to accept the fact that it is “legal” for their husbands to violate them.
God has created the human being and made him unique, giving him a sacred body that he should take care of throughout his life. This means that every single person should respect his body and others' bodies in the mean time. Rape is rape no matter how or with whom it is.

He has definitely no right to abuse his wife's body to satisfy his own needs. Rape isn't rape only when an unknown person forces someone to have sex against their will. A husband may also rape his wife by physical means or even verbal ones, by maltreating her in all ways. So of course marital rape should also be penalized, because it is rape after all and against social norms.
In my opinion, marital rape should be considered as a crime. Although women give themselves up to their spouse as they get married, it doesn't give the man the right to pursue any action without her consent. In fact, men should respect a woman's opinion. Therefore, marital rape is a crime like any other. Personally, i think that even though you are married, a person still has his own civil rights. To this case, a woman should be able to defend herself from any obstacles that would ruin her freedom.
The word rape is considered a crime whether it was marital rape or normal rape. Its true that when a couple get married they become one person, but the definition for that is that they have 1 soul not 1 body. In my opinion, marital rape is a crime since it involves the process of "rape". Rape is abuse, and any type of abuse should be a crime. The fact that one is forcing another person to have sexual intercourse without their approval is disturbing, even for married couples. One thing that marriage offers is sexual contact between the husband and wife. However, this privilege is based on the agreement of both, the husband and wife. Forcing the other against his/her own desire is mistreating this privilege.

Maybe when two people get married “they are granted rights to each other’s bodies” and religion says so… but can we deny that marriage should be based on mutual love, respect and on top of all agreement. One should respect the other partner’s decision, opinion or belief. Getting the person you are married to, to follow your will in a coercive way, is destroying the special bond of marriage willingly. I totally agree with the author on this matter it should be illegal to commit rape within the marriage, and if we want to really stop this, the people concerned by this matter should step up and make a point or maybe participate in the events concerning this cause, cause if they don’t do something about it, nothing is going to change.

I don't think this whole matter is really easy.
There is a family involved, maybe there are kids involved, and even a woman's reputation involved. In our society a woman will be blamed for everything she does, because a man is just too " perfect " .
But yes, we, the "non-victims" , should stand up for these people who are suffering much, and we should refuse this, and try to achieve equality between women and men as much as we can, and as much as society can handle.

I had worked last year on a report on the Lebanese laws regarding rape. And while some are too extremes that should definitely be condemned, others can somehow be justified.
One of the reasons defending the current Lebanese laws was that legalizing such an act and sticking up to it 100% would lead to a separation of many families.
While of course I am completely against rape, I truly believe that the issue of marital rape needs thorough studying before making it easy for the wife or husband to file a case and then just condemning the other to prison. What if there were kids involved? What if it really was the woman's(or man's) fault for not sexually pleasing her husband(his wife)? What if the person was just using it as an excuse to get out of a bad marriage?. Our society is not open enough to handle a large increase of divorce rate and family break-ups.
I am all in for human rights, I just believe that each case should be thoroughly studied, before giving couples an easy way out and causing many damages in the society.

DeleteIndeed you have a very interesting point in what you just said. Many tend to turn their backs on some pretty important aspects of the issue such as the point you mentioned. When a group demands for such a law, they need to be aware of all the outcomes this law might result in; that's why in my opinion the law hadn't been set in Lebanon.

This makes me wonder of what marriage means to me and what it means to others. Marriage is not about controlling your spouse, it is about understanding, protecting, and respecting them. I think that one has the right to forbid their wife or husband from having sexual relation s with another person. That's the extent in which one has the right to their spouse's body, otherwise a husband must respect his wife the same way a wife must respect her husband.
I think that a woman is not condemned to obey the desire and fantasies of her husband by force. She's neither an object nor a toy , she's a human being who possesses rights that the opposite sex should respect.

ReplyDeleteI absolutely think rape should be considered as a crime even if it was a marital rape. Anyone who commits it should face a severe punishment. It even opposes to the main concept of a relationship which is the respect between husband and wife. There should be a law against it in order to prevent women from being hurt, not only on the physical level but also on the psychological. First of all, it will cause very deep damages whose effects will last forever. Second of all if we want to allow marital rape, this love between the couple will be nothing but a lie. Besides that, I hate when people use religion as a tool that allow them to use their wife’s body as they like to because it’s not true. The main purpose of the religion is to unite people and to help us to live in a peaceful community based on respect. Finally, we are living in a society as humans that have rights that should be respected and so anyone who tries to abuse them in order to bring him pleasure should face some sever consequences.

Even though in religion they say that each one owns the body of their partner in a couple, it shouldn't be applied in any laws. DeleteIn the legal point of view, rape is a crime if a person is not married, since it is unnatural to make someone do what you want if they don't want to, rape is a definite crime. When you're married, a husband is legally wise allowed to rape his wife, but actually it's a crime against nature, it is not normal that a man oblige a girl to go through this if he doesn't have her blessing. Even though it's legally allowed, it's naturally disapproved.

ReplyDeleteIf someone forces the other to do something against his/her will, it is wrong. In case of repetition, it is considered a crime, especially when it comes to marital rape because it is not just an act that inflicts physical damage; it damages the spirit of the raped person in every way and her/his personality will change to worse.
ReplyDeleteAlthough marital rape and rape itself are almost the same and both are immoral acts, marital rape could be considered even more immoral since the offender (often the husband) will be dramatically mistreating the confidence that the other entrusted. It is very heinous for the spouse who gets raped to feel unsafe in his/her own house when his/her "other half" is around. Instead of closing your eyes because you should feel safe, you keep them wide open because you shouldn’t close them. If it is stated in religion that marital rape is allowed, delete that statement. If the law says marital rape isn’t that bad, change the law because this way, religion and the law will be encouraging rape in general (marital rape in particular) by setting no severe consequences to the offender when (s)he should be badly penalized.
The bottom line is that rape is a crime, so marital rape should be no different since it is rape but the offended happens to be more than a stranger. It is time for the mistreated people to stand against rape, the obnoxious act.

ReplyDeleteThe fact that marital rape is rarely a onetime event may have worse consequences on a person than a one-time rape by an unknown individual. With time women that are sexually abused by their husbands will be transformed into a different person, and often these women end up by committing suicide or a crime .So a wife that once was a victim can become a criminal. And often the victims of this transformation are the innocent kids.

Marital rape is a crime. Even if they are married, a man doesn't have the right to force his wife to please him sexually. If we are talking about "rape" whether it is marital or not, we are talking about violence. I don't understand how a man get please after sleeping with a woman by force. It is really ugly. Moreover, this could lead to divorce. If the woman is well educated, and know what are her rights, i believe that woman would leave the house. She wont support going through all the psychological and the physical pain regularly. I think that the marital rape should be penalised. Governement and feminist organisation should enlight the woman about their rights. Marital rape MUST be penalised by in Lebanon in the whole world. DeleteI really enjoyed Midashi's text because it speaks of a very important problem in need of solving as soon as possible. I, like Mikdashi, believe that rape is rape no matter what the relationship of the two parties are (married, engaged, strangers, friends...). We should have the right to decide what our body has to go through. It's part of freedom. I own my body, only me not anyone else. I firmly agree that marital rape should be penalized because it's a criminal act and I also think it is even worse than actual rape. When two people get married they must have respect towards each other and thus respect their choices and their needs. Not because they are granted rights to each others bodies that one can not say no to sexual intercourse. Sex should be wanted by both parties not forced, it should be out of love and compassion and thus, one can not do it against his/her will. I'm with a law against marital rape because it's a right to every human being to decide what happens to their body and it is considered as physically abusing a person.

Being granted the rights to another person's body doesn't mean you get to abuse and violate it. On the contrary, it comes with great responsibility and respect. This means having to take care of it as if it were your own. A man that violates his spouse's body has also violated the whole concept of marriage.

Marital Rape should definitely be penalized. Many might say that the woman married the man in the first place and it should be her duty to please him. But that does not give him the right to violate her in any way or form. Sometimes men hide their true identity until after the wedding and then become violent predators who treat their wives like garbage and even vice-versa. It is the spouses duty to show the husband his limits. Even if in some religions it is stated that it is the women's obligation to please her husband, women should not blindly follow what any holy book dictates. Rape is rape, no matter who is involved and its actions must be severely penalized before the court of law, but for that to happen, the wife must be brave enough to step up and admit to what is happening to her. ReplyDeleteI hate when people start talking about rape as if it was a legal action, and start finding a place for it in our society...Well the definition of this word is: a sexual violence commited by a man forcing a woman to have sex with him. The word "forcing" explains it all, if two are not married, it is imperative to think that sexual relationship between them should be allowed, and that is what some religions support. However I think that marriage is a totally different thing, a couple is married when each one of them has promised his partner to love him and respect him all his life. So according to that, their bodies shouldn't be an obstacle between them because they are sharing everything. Then it's obscene to think that marital rape is a crime. In fact we can't call it rape because it isn't. When a couple agrees to get married then they agree to put in common everything and have sex. Like the child that is born is the fruit of the two parents, pleasure in sex has to be from both sides too. A phenomenon which has been prevailing in societies is marital rape. This issue has emerged out of null, and it has provoked many variant and divergent responses. Numerous people consider that there is no existence of what is called “marital rape” for two people who are spiritually and legally bounded together have utter access to each other’s bodies meaning that a man may urge his wife to have sex with him even if she refuses it. This is completely demeaning to human rights, especially women’s rights. Making love is the process through which love is transformed into action and where the physical barrier becomes sheer and insignificant with respect to the desires, lusts, and the fiery feelings. If a woman does not wish to have sex with her husband, then it is very likely that it’s due to psychological troubles or even to the rejection of the wife to her own husband, meaning that she despises him and does not wish to relate to him by any means. Consequently, there exists marital rape where a husband forces him wife who is unwilling to engage in this particular activity with him. Any random act which shows unwillingness should not to forced onto someone, and this is exactly the case in marital rape. so there is no logical reason why some people still resort to that crap. we boast of how intellectually modern we are, and how we are respecting and creating new rules to save everyone’s rights, but this parasite covers up all these pluses and automatically gives a bad name to our society which we are so proud to be in. No one really knows what happens in a couple's sex life, wether they are active or totally dormant, this issues may lead to many problems, some may reach to divorce, but even divorce is legal and deals with the problem sanely, but marital rape is just stupid. This act throughout the world is forbidden, and in my opinion, all the penalties are fair and well studied to matter how harsh some may "feel" they are. Other than that, rape is also dealt personally before it reaches the court, even inmates tend to get rid of the other inmates that have been convicted with rape, because everyone one of them has a mother or a daughter or a sister that even the coldest heart, and most ruthless criminal wouldn't allow anything to happen to them. Rape no matter what is definitely a crime because its against all laws,rights,and morals, but some traditional conditions may end the subject smoothly without any penalties, its this factor that should be crucially changed. We live in an era that we have a solution for almost every problem; therapists, pills, movies and all that "shameful" stuff may actually help one's sexual life with his or her partner , so why resort to rape when the pleasure is for half an hour and the pain for the rest of your shortened life?!
What is considered a crime in society is what is illegitimate to human rights. Say a person was pushed into doing something out of his will, his freedom will be taken away from him. A man's freedom of action or speech is what is most valuable, when it is taken away from him it is a crime against his person. If one was forced into a sexual relation it is not legitimate, therefor it is a crime. A case of rape is an issue in society because the person is being marked both physically and morally. That is why therapists specialize in rape for example to reduce the trauma one goes through. Rape is definitely a crime and should be fought against.
ReplyDeleteThe difference here is that we are dealing with marital rape. One who considers marriage a mutual relation is right. But that does not imply that marriage is an excuse to oblige or abuse the partner into a sexual relation if not agreed. I believe marital rape is rape, and as I had proven earlier rape is a crime. There aren't any excuses for rape.
